POOSTORE TERMS AND CONDITIONS OF USE AND PURCHASE

These Terms and Conditions of Use and Purchase (hereinafter, the “Terms”) govern access to, browsing, registration on, and use of www.poostorelatam.com, as well as the purchase of digital products and services offered by PooStore.

Taking such action shall constitute an electronic manifestation of acceptance of the conditions applicable to the transaction, to the extent permitted by applicable law.

Electronic acceptance shall have the legal effect permitted by applicable law and shall not be considered invalid solely because it was made by electronic means.

  • top-ups using an ID or UID;
  • internal top-ups;

The availability of each product may depend on the video game, developer, publisher, provider, region, server, platform, country, inventory, or distribution system used.

PooStore may add, modify, suspend, or remove products from its catalog when necessary.

The appearance of a product on the website does not guarantee its permanent availability.

4. RELATIONSHIP WITH VIDEO GAMES, BRANDS, AND THIRD PARTIES

PooStore operates as an independent store.

Unless expressly stated otherwise, Poostorelatam LLC is not the owner, developer, publisher, or operator of the video games, platforms, or brands whose products may be available through PooStore.

5. REQUIREMENTS FOR USING POOSTORE

The user represents that they have sufficient legal capacity to enter into transactions through PooStore.

If the user is a minor under the laws applicable to them, they may use the services only with the authorization and supervision of a parent, guardian, or legal representative.

The person authorizing a minor to use PooStore shall be responsible for supervising purchases made under such authorization.

PooStore may reject or cancel a transaction when there are reasonable grounds to believe that the person attempting to complete it lacks authorization to do so.

6. USER ACCOUNTS

Some services may require the creation of an account.

The user agrees to provide truthful, current, and sufficient information.

The user is responsible for maintaining the security and confidentiality of:

7. RESPONSIBILITY FOR TOP-UP INFORMATION

Many PooStore products require the customer to provide specific information in order to complete delivery.

  • country;
  • platform;
  • email address;
  • account identifier;
  • or other necessary information.

The customer is responsible for carefully verifying that all information entered is correct before confirming the purchase.

PooStore will process the order using the information provided by the customer.

If a top-up has been correctly sent to the ID, UID, server, region, email address, or account provided by the user, PooStore shall not be required to repeat the transaction or issue a refund when the error results from incorrect information entered by the customer, unless applicable law provides otherwise.

8. ID, UID, OR PLAYER NAME VERIFICATION

For certain video games, PooStore may provide mechanisms designed to verify information associated with an ID or UID before completing a top-up.

The availability of these tools does not relieve the customer of responsibility for verifying the destination of the purchase.

These systems may depend on APIs, providers, or external services and, therefore, PooStore does not guarantee that they will be continuously available or capable of verifying every product, region, or account.

When account information cannot be verified automatically, the customer is responsible for entering it correctly.

9. INTERNAL TOP-UPS

Some products may require procedures other than a direct ID-based top-up.

Where an internal top-up requires additional information or temporary access to an account authorized by the customer, such information will be used only to the extent reasonably necessary to provide the requested service.

The customer must ensure that:

  • they are authorized to use the account;
  • the information provided is correct;
  • the account allows the requested transaction;
  • and they provide any authorization or code that may be required.

PooStore may place a transaction on hold when confirmation, additional authentication, or customer cooperation is required.

Information provided shall also be subject to PooStore’s Privacy Policy.

10. GIFT CARDS, PREPAID CARDS, AND DIGITAL CODES

Gift cards and digital codes may be subject to restrictions relating to:

  • country;
  • region;
  • currency;
  • platform;
  • account type;
  • device;
  • or service.
  • The customer must verify product compatibility before purchasing.

For example, a card intended for the United States may not work on an account registered in another country.

Once a valid digital code has been delivered or revealed to the customer, the customer shall be responsible for its storage and use.

PooStore shall not be responsible for codes that are subsequently:

  • shared;
  • published;
  • resold;
  • lost;
  • used by third parties;
  • or compromised for reasons beyond PooStore’s control.

When a customer reports that a delivered code does not work, PooStore may request evidence and conduct verification with the relevant provider.

Any replacement or refund will depend on the outcome of such verification.

11. PRODUCT INFORMATION

PooStore endeavors to keep product descriptions, quantities, images, regions, prices, and features up to date.

However, certain information may be changed by developers or providers without prior notice.

Images may be used for illustrative purposes.

When there is a material difference between the information displayed and the product available before a transaction is completed, PooStore may cancel the order, notify the customer, or propose an alternative.

12. PLACING AND ACCEPTANCE OF ORDERS

Placing an order does not necessarily mean that it has been finally accepted by PooStore.

An order may be subject to:

  • anti-fraud checks;

  • provider requirements;

PooStore may reject or cancel an order before delivery when there is a reasonable basis to do so.

When a paid order is canceled before delivery, PooStore will process the corresponding refund when legally and technically appropriate.

13. PRICES

Screenshots, historical prices, expired promotional publications, or values temporarily stored in the browser shall not bind PooStore after the price has been updated.

When an obvious pricing error occurs, PooStore may cancel the transaction and refund the amount received or inform the customer of the correct price before proceeding.

14. CURRENCIES AND EXCHANGE RATES

When a transaction involves currency conversion, exchange rates determined by PooStore, payment providers, or other intermediaries may be used.

These rates may change frequently.

Banks, card issuers, digital wallets, exchanges, payment processors, and other third parties may apply their own rates or fees.

PooStore shall not be responsible for fees applied directly by third parties that have been properly disclosed or arise from the relationship between the customer and such third party.

15. TAXES AND CHARGES

Where legally required, certain taxes, fees, or charges may be included in the price or added during checkout.

The tax treatment of a transaction may vary depending on the customer’s location, the nature of the product, and applicable law.

The customer shall be responsible for any tax or charge legally applicable to them that has not been collected directly by PooStore.

16. PAYMENT METHODS

  • provider;
  • and operating conditions.
  • PooStore may add, remove, or restrict payment methods.

Submitting a payment receipt or screenshot does not necessarily mean that payment has been confirmed.

PooStore may verify that funds have actually been received before delivering the product.

Where the amount received differs from the required amount, the transaction may remain on hold until the discrepancy is resolved.

17. PAYMENTS MADE BY THIRD PARTIES

The user represents that they are authorized to use the selected payment method.

When the payment method belongs to a person other than the user making the purchase, PooStore may request information intended to verify that the transaction is authorized.

PooStore may delay or reject a transaction when there is a material discrepancy between:

  • the buyer;
  • the payment holder;
  • the information provided;

  • or transaction behavior.

PooStore may use manual or automated mechanisms to detect:

  • fraudulent chargebacks;
  • account theft;

The user agrees to provide authentic information during any verification process.

PooStore may temporarily place an order under review while such checks are carried out.

PooStore shall not be required to disclose its internal fraud detection criteria where such disclosure could compromise the security of the platform.

19. COMPLIANCE WITH SANCTIONS AND LEGAL RESTRICTIONS

Poostorelatam LLC is a company organized in the United States and, as such, must comply with applicable U.S. laws and regulations, including those related to economic and trade sanctions.

PooStore may reject, suspend, cancel, or review a transaction when necessary to comply with:

  • economic sanctions;
  • trade restrictions;
  • government orders;
  • regulatory requirements;
  • anti-money laundering requirements;
  • obligations imposed by financial service providers;
  • or any other applicable legal requirement.

The user represents that they will not use PooStore services to carry out any transaction prohibited by applicable law.

Where the law prohibits PooStore from processing, returning, transferring, or otherwise dealing with certain funds, PooStore may be legally prevented from refunding them immediately and will act in accordance with applicable legal obligations.

A person’s residence or nationality in a country subject to certain measures or sanctions does not, by itself, necessarily mean that the person is prohibited from using PooStore; each transaction may be evaluated according to the specific legal restrictions that apply.

20. PROCESSING AND DELIVERY TIMES

PooStore endeavors to complete digital deliveries within the shortest reasonably possible time.

Times indicated on the website, social media, support channels, or promotional materials are considered estimates unless expressly stated otherwise.

A transaction may be delayed due to:

  • payment review;
  • anti-fraud controls;
  • maintenance;
  • high demand;
  • temporary lack of inventory;
  • provider issues;
  • server outages;
  • video game maintenance;
  • regional restrictions;
  • third-party errors;
  • Internet failures;
  • or circumstances beyond PooStore’s reasonable control.
  • A delay does not automatically mean that an order has failed.

When a product definitively cannot be delivered, PooStore will evaluate the appropriate replacement, store credit, or refund.

21. AVAILABILITY AND THIRD-PARTY PROVIDERS

22. DIGITAL PRODUCTS ALREADY DELIVERED

Once a transaction has been correctly completed, the customer shall not have an automatic right to cancel it simply because they changed their mind.

The foregoing does not affect any rights that may legally apply to the consumer or cases where PooStore has made a verifiable error.

23. ERRORS MADE BY THE CUSTOMER

Before confirming a purchase, the user must carefully verify:

  • product;
  • quantity;
  • video game;
  • ID or UID;
  • server;
  • region;
  • country;
  • email address;
  • platform;
  • and product compatibility.

When PooStore has correctly completed the transaction in accordance with the information provided, an error made by the customer shall not automatically create a right to a refund or repeat top-up.

PooStore may attempt to assist when technically possible, but does not guarantee that a completed top-up can be recovered, transferred, or reversed.

24. ERRORS ATTRIBUTABLE TO POOSTORE

When there is evidence that a transaction was processed incorrectly as a direct result of an error attributable to PooStore, the user must contact support.

Once the error has been verified, PooStore may, depending on the circumstances:

  • correctly complete the transaction;
  • replace the product;
  • provide equivalent credit;
  • or issue a refund.

The applicable remedy will depend on the status of the transaction and the nature of the product.

25. CANCELLATIONS, RETURNS, AND REFUNDS

Refunds shall also be governed by PooStore’s Refunds and Returns Policy.

As a general rule, an order that has not yet begun processing may be eligible for cancellation where technically and legally possible.

Digital transactions that have already been credited, revealed, activated, or consumed generally cannot be reversed.

Circumstances that may justify a refund include:

  • definitive inability to deliver the product;
  • a verified duplicate charge;
  • an error attributable to PooStore;
  • cancellation of an order before delivery;
  • or any situation required by applicable law.
  • Each request may be reviewed individually.

PooStore may request the order number, payment receipt, communications, evidence, and any other information reasonably necessary to resolve the request.

26. CHARGEBACKS, REVERSALS, AND PAYMENT DISPUTES

If the customer believes there is a problem with a purchase, they are encouraged to contact PooStore first through our official support channels so that the transaction may be investigated.

This does not limit any legal right the consumer may have to submit a valid dispute to their bank, card issuer, or payment processor.

When a chargeback or dispute is initiated after a product has been correctly delivered, PooStore may provide the payment processor with evidence reasonably necessary to demonstrate fulfillment of the transaction.

Where legally appropriate, such evidence may include:

  • order number;
  • payment records;
  • delivery information;
  • technical records;
  • communications;
  • verification records;
  • and other information related to the transaction.

Deliberately initiating fraudulent chargebacks or false claims may result in account restrictions.

PooStore will not penalize a user merely for legitimately exercising dispute rights granted by applicable law.

27. PROMOTIONS AND DISCOUNTS

PooStore may offer:

  • discounts;
  • promotional codes;
  • bonuses;
  • giveaways;
  • promotions;
  • limited-time offers;
  • or special benefits.

Each promotion may be subject to specific conditions relating to duration, availability, product, quantity, country, user, or payment method.

Promotions provided by external developers or providers may end or change without PooStore’s involvement.

Unless expressly stated otherwise, promotions:

  • cannot be redeemed for cash;
  • do not apply retroactively;
  • cannot be combined;
  • and may be subject to availability.

PooStore may invalidate benefits obtained through fraud, manipulation, or deliberate exploitation of errors.

28. OFFICIAL CHANNELS AND IMPERSONATION PREVENTION

PooStore’s official channels are those published or directly linked from www.poostorelatam.com or officially communicated by Poostorelatam LLC.

The user must verify the authenticity of any account, phone number, email address, website, or social media profile before making a payment or providing information.

Poostorelatam LLC shall not be responsible for payments sent to persons, websites, profiles, bank accounts, or phone numbers that fraudulently impersonate PooStore and are not official channels.

29. PROHIBITED USES

The user may not use PooStore to:

  • commit fraud;

  • conduct unlawful transactions;
  • distribute malware;

  • engage in unauthorized reverse engineering;
  • collect data using unauthorized automated mechanisms;
  • threaten or harass staff;
  • or use the service for purposes contrary to applicable law.

PooStore may immediately suspend accounts associated with conduct of this nature.

30. INTELLECTUAL PROPERTY

The PooStore name, visual identity, website design, logo, original text, software, structure, graphic elements, and other materials developed or licensed specifically for PooStore are protected by applicable intellectual property laws.

Access to the platform does not grant the user ownership rights over such materials.

Users may not copy, reproduce, modify, distribute, sell, or commercially exploit PooStore’s proprietary content without authorization, except where expressly permitted by law.

Third-party trademarks, video games, and materials shall remain the property of their respective owners.

31. PRIVACY AND DATA PROTECTION

PooStore may collect and process information necessary to:

  • manage accounts;
  • process orders;

  • prevent fraud;

33. LIMITATION OF LIABILITY

PooStore shall remain responsible for obligations that cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, Poostorelatam LLC shall not be responsible for losses caused exclusively by:

  • properly disclosed regional incompatibility;
  • decisions made by external developers or platforms;
  • suspension of a video game account by a third party;
  • provider failures;
  • Internet interruptions;
  • maintenance of external servers;
  • charges imposed by financial institutions;
  • loss of codes after delivery;
  • unauthorized use resulting from the user’s own negligence;
  • or events beyond PooStore’s reasonable control.

PooStore also does not guarantee any particular result within a video game arising from the purchase of virtual currency, passes, or digital products.

Nothing in these Terms shall exclude liability that cannot legally be limited.

34. FORCE MAJEURE

PooStore shall not be responsible for delays or temporary failures to perform caused by events beyond its reasonable control.

Such events may include:

  • natural disasters;
  • conflicts;
  • power outages;
  • widespread Internet failures;
  • cyberattacks;
  • government measures;
  • banking failures;
  • payment processor issues;
  • provider failures;
  • unavailability of video game servers;
  • telecommunications interruptions;

PooStore will make reasonable efforts to restore the service or resolve affected transactions where possible.

35. ACCOUNT SUSPENSION OR TERMINATION

PooStore may restrict, suspend, or terminate an account when there are reasonable indications of:

  • fraud;
  • unlawful use;
  • security risk;
  • false information;
  • fraudulent chargebacks;
  • material breach of these Terms;
  • abuse of promotions;

Where reasonably possible, PooStore may request additional information before making a final decision.

Suspension of an account does not eliminate obligations or disputes arising before the suspension.

40. GOVERNING LAW

These Terms and the contractual relationship between the user and Poostorelatam LLC shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without prejudice to any mandatory consumer protection laws applicable to the user that cannot legally be excluded by contract.

The choice of Wyoming law is not intended to deprive a consumer of any non-waivable rights available to them under the applicable laws of their jurisdiction.

41. DISPUTE RESOLUTION

If a dispute arises in connection with a purchase, account, payment, product, or use of PooStore services, the user should contact Poostorelatam LLC through our official support channels, provided that doing so does not limit any right legally available to the user.

Claims may be submitted to:

PooStore will endeavor to investigate the claim in good faith and seek an amicable resolution within a reasonable period of time.

If a dispute cannot be resolved through this process and to the maximum extent permitted by applicable law, any judicial proceeding relating to these Terms or PooStore services shall be submitted to the courts of competent jurisdiction of the State of Wyoming and, where applicable, to the federal courts having jurisdiction in that state.

This provision shall not prevent a consumer from exercising rights before administrative agencies, financial institutions, courts, or other authorities where such rights cannot be contractually limited under applicable law.

42. SEVERABILITY

If any provision of these Terms is declared invalid, illegal, or unenforceable by a competent authority, such provision shall be interpreted or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

43. NO WAIVER

The failure of Poostorelatam LLC to immediately exercise any right established under these Terms shall not constitute a permanent waiver of that right.

44. ASSIGNMENT

The user may not transfer their rights or obligations under these Terms to a third party where doing so would interfere with the performance of a transaction or involve unauthorized use of an account.
